Gazette Notice No. 6567: The Constitution of Kenya, The Judicial Service Act
Chief Justice Martha Koome issued guidelines for transferring personal injury claims arising from road accidents from the small claims court to the Magistrate’s Courts. This followed the High Court of Kenya's judgment dated 22nd of January 2026 in Gathaiya vs the AG and 2 others; and 176 Interested Parties (Petition E8 and E10 of 2024 (Consolidated)) where the court declared that all pending personal injury claims arising from road accidents before the Small Claims court be transferred and are deemed transferred to the Magistrates’ court with jurisdiction. Recent Kenyan Court decisions
ODPC Complaint No. 1724 of 2025: Ian Itolondo Mutoro vs Waithera Imani, 4 February,2026
The case marks a significant development in clarifying that digital content creation is not exempt from data protection requirements merely by virtue of its informal or entertainment-driven character. The ODPC’s determination in Complaint No. 1724 of 2025 represents a critical step in aligning Kenya’s digital content ecosystem with the requirements of modern data protection law. It affirms that creative expression in the digital space is subject to legal limits where personal data is involved.
HCCOMM/E407/2022: Peter Nthei Muoki & Beluga Limited v Safaricom PLC 8 May,2026
In a case where intellectual property had been registered by the Plaintiffs with the Kenya Copyright Board, and then shared with Safaricom, the court affirmed the protection of intellectual property in Kenya. Although Safaricom initially claimed the product was not implementable without regulatory hurdles, they on November 2022 launched a strikingly similar product, “M-PESA Go” (formerly “Manage Child Account”). By awarding Kshs. 1,400,067,000.00 in general damages and an ongoing 0.5% royalty of gross M-PESA revenue for the product, the Court has signalled that taking an idea is a billion-shilling liability.
Court of Appeal Case in Barclays Bank of Kenya Limited v. Banking Insurance & Finance Union, 30 April, 2026
The Court of Appeal in Nairobi Civil Appeal No. 7 of 2020 affirmed that the terms of a registered Collective Bargaining Agreement (CBA) are binding on the parties and prevail where they provide greater protection than the statutory minimum under the Employment Act. The court affirmed that registered CBAs in the case prevailed over basic statutory minimums making the termination procedurally unfair due to skipped procedural steps

The Milimani High Court ruled that state administrative inaction and refusal to update sex and gender markers on identification documents for individuals who have transitioned violates constitutional rights.
Employment and Labour Court in Njunge v Kentalya Plc 29 May, 2026
The Employment and Labour court in Nakuru reaffirmed the principle that the validity of a termination must be assessed on the basis of the reasons known to and relied upon by the employer at the time the dismissal decision is made.
High Court of Kenya in SBM Bank of Kenya v Siltech Systems Limited & 4 others 21 May,2026
The High Court of Kenya ruled in favor of SBM Bank in a commercial debt recovery suit involving corporate loan defaults, the Turquand Rule, and directors' personal guarantees.In a nutshell, the decision affirms that fiduciary obligations are not merely peripheral.Company directors should diligently adhere to their fiduciary obligations such as promptly attending Board meetings, in order to avert potential risks in future. Additionally, company directors should first seek legal advice before giving personal guarantees and indemnities.
Recent Kenya Laws
Geographical Indications Bill, 2026
If enacted, the Bill will establish a dedicated legal framework for the registration, protection and enforcement of geographical indications in Kenya. This proposed law is particularly significant for Kenya, a country renowned for region-specific products including but not limited to Tinderet tea, Taita Baskets, Mt. Kenya Coffee, and Kisii Soapstone. Until now, Kenya has lacked a standalone legal regime dedicated to safeguarding such products from imitation, misuse and unfair commercial exploitation. The proposed law is a strategic economic tool designed to establish a formal institutional mechanism to safeguard geographical indications; Stop the misappropriation of Kenya’s unique products by unauthorized parties; and Shield the public from deception regarding the true origin or quality of goods. The proposed law presents an opportunity to transform local identity into commercial strength, opening new pathways for investment, premium markets and global recognition.
