Gazette Notice No. 9829 :Supreme Court Of Kenya August Recess, 2026
Martha K. Koome, Chief Justice and President of the Supreme Court of Kenya gives notice that the Supreme Court August recess will commence on Saturday, 1st August, 2026 and terminate on Tuesday, 15th September, 2026 both days inclusive. The duty Judge will be available during recess to deal with urgent matters. During this period, the Supreme Court Registry shall be open to the public from 8.30 a.m. to 5.00 p.m. on all weekdays other than public holidays.

Martha K. Koome, Chief Justice and President of the Supreme Court of Kenya designates – Hon. Stephen Jalang’o Senior Principal Magistrate as an Adjudicator in any proceedings under the Act, at Milimani Small Claims Court, Nairobi County, for a period of twelve (12) months, with effect from the 1st July, 2026.

Recent Kenyan Court decisions
Court of Appeal in Kaangi & another v Pulei (Suing as the Personal Representative of the Estate of Kasaine Pulei Kinyoei alias Kasina Ole Pulei) & 8 others July 3, 2026.
The Court of Appeal in focusing on due process and land rights, emphasized that a court cannot order the cancellation of a title deed without ensuring the registered title holders are properly joined as parties to the suit.
Employment and Labour Relations Court in Lucy Wacheke Gatere v Royal Tulip Canaan Nairobi & another, July 21, 2026
The court ruled that an employer cannot fire a worker orally and then use a later disciplinary process to fix that illegal action. The court also found that searching a company computer for valid work reasons does not break privacy rules, even if personal files are found. The hotel was ordered to pay about KSh 1.1 million for unfair termination.
Court of Appeal in Kenya County Government Workers’ Union v. Embu County Government & another, July 24, 2026,
The court ruled that continuous short-term or casual contracts cannot be used to disguise permanent employment. It also declared that labeling workers as "casuals" indefinitely violates fair labor practices under Article 41 of the Constitution and the Employment Act and and ordered the county government to regularize the affected workers' terms forthwith.
